How to Own Real Estate in Mexico Fideicomiso
The Fideicomiso is the bank trust of Mexico that has the power to issue land ownership to non-Mexicans. Property inside the Baja Peninsula (land within 30 miles of the beach and 50 miles of the border) may be acquired when the Fideicomiso names the buyer a beneficiary of the trust and the bank as a trustee. The trust lasts for 50 years and may be perpetually renewed. The buyer/beneficiary has full ownership rights to the land and may build, renovate, rent, lease, or sell at any time conforming to the general laws of the country.

In order to establish the Fideicomiso please apply to the Secretary of Foreign Relations and include a description of the property, its intended usage, and personal date on each of the beneficiaries. Once granted, the bank will create the trust document, which will be recorded in Sonora.

The cost of establishing a trust will depend upon the appraised value of the property. You can expect to pay a closing cost of around $5,000 US Dollars (subject to change).
